Acting for the Seller
- We act on behalf of a client who wishes to sell a property.
- We do so under contract with the client, for which we charge a commission in accordance with the value of the property to the seller.
- The price is set by the seller, who has the right to change it at any stage prior to a signed and sealed sales contract.
- We advertise the property and show it to prospective buyers.
- We hold basic information on the boundaries and layout as supplied by the client — the authenticity of this documentation is guaranteed by the seller under their agreement with Lamu Realty.
- We negotiate the price on the client's behalf.
- Once ready to proceed, the prospective buyer furnishes Lamu Realty with a letter of interest.
- On receipt of this letter of interest, we hand the buyer over to the seller, or to their respective legal representatives.
- At this point, Lamu Realty's contractual obligation to the seller ends.
- All matters relating to the sales contract are strictly between the seller's and buyer's legal representatives.
- It is the buyer's obligation to exercise "due diligence" in verifying the documentation of the property as supplied by the seller.
Acting for the Buyer, Too
Kenyan law provides for the possibility of Lamu Realty subsequently acting for the buyer as well. This is not considered a conflict of interest, as the successful and speedy conclusion of the sale is in both parties' interest, and our contractual obligation to the seller had already ended with the hand-over of the buyer.
Under a separate contract of service to the buyer, we can provide in-depth verification of documents, including:
- Original and verified copies of the GOK / Survey of Kenya registered survey map for the property
- Verified copy of the RIM Indent
- Verified copy of the RIM
- Copy of the Ministry of Lands letter authorising issue of title
- Title search
⚠️ What We Don't Do
- We do not carry out property appraisals.
- We do not engage in any form of legal services.
